What determines the chances of counter-espionage? Mine is almost always 1%, but I've seen it spike a couple of times to 20% or so.

A Few things factor into counter-esp
The biggest one is your Esp Tech. The higher yours is vs. your opponent, the easier it is for you to get a spy report on him and the harder it is for him to get one on you, without loosing any probes.
If you are even with your opponent, or have less esp tech than, the only way to see all parts of a spy report is to send higher number of probes, thus increasing chance of being shot down.
A second variable would be how many probes are on the planet you are probing. The more probes on a planet, the better chances of them spotting your probes, and thus shooting them down.
The more often someones planet is probed in a given hour (Its either an hour or half hour can't remember which) the more likely that subsequent probings will be caught. If you probe someone with 3 probes with a 5% chance of being shot down, then 10 minutes later launch 3 more probes, the chance of being shot down will in-crease. Including if another person is probing the planet from somewhere else. It has to do with the atmospheric activity or something. I don't know by how much it increases chances, and it really depends on esp-tech differences and number of probes, but I've seen it happen on many occasions.
Keep in mind, that even with a 100% chance of being shot down, you STILL get the report, you just lose the probes in the process.

I saw somewhere that defenses and fleet size also determine the percent of counter espionage...but I doubt that's true.

Destroying an enemy's Espionage Probes by Counterespionage does not stop the probes sending their information. The information will still reach your enemy even though their probes were destroyed.

Destroying them inst the objective, hiding informatoin is.
If you don't level up your ESP Science, then you can't see what other people have and all it takes is 1 probe to see yours.
Also, it gets tiresome to constantly rebuild your lost Probes.
